Beneficiary

A beneficiary is any person or entity legally entitled to receive assets, income, or other benefits from a trust, insurance policy, retirement account, or estate.

In the context of a trust, beneficiaries are named in the trust agreement and may receive benefits in different ways: a fixed income stream, discretionary distributions at the trustee's judgment, or a lump sum at a specified age or event. A single trust often has multiple beneficiaries — current beneficiaries who receive income now and remainder beneficiaries who receive assets when the trust eventually terminates. These interests can sometimes conflict, and the trustee must balance them fairly.

The term extends beyond trusts. On a life insurance policy or retirement account, a named beneficiary receives the proceeds directly at death, bypassing probate entirely. This makes beneficiary designations a surprisingly powerful estate-planning tool — and a common source of unintended outcomes when families forget to update them after marriages, divorces, or deaths. Families commonly review all beneficiary designations as part of an initial asset inventory when organizing a family office.

A concrete confusion worth addressing: being a beneficiary does not mean having access to assets on demand. A discretionary beneficiary in a spendthrift trust (one designed to protect assets from a beneficiary's creditors or poor decisions) may request distributions but the trustee decides whether to grant them. Understanding the difference between being named a beneficiary and having enforceable rights to specific assets requires reading the trust agreement carefully — and in complex cases, consulting a qualified attorney.
