Situs

Situs is the legal jurisdiction whose laws govern a trust — determining rules on taxation, creditor protection, duration, and administration.

When a family creates a trust, they are not simply signing a document — they are choosing which state's or country's legal system will referee that trust for potentially decades. That choice is called the trust's situs. Different jurisdictions have different rules on how long a trust can last, whether creditors can reach trust assets, what taxes apply at the trust level, and how much flexibility trustees have. Situs selection is a deliberate planning decision, not an administrative formality, and it fits within the broader work of building a family office's legal framework.

A family office overseeing a dynasty trust might choose a jurisdiction known for favorable long-duration rules, strong asset-protection statutes, or no state-level income tax on trust earnings. For illustrative purposes, families sometimes move an existing trust — a process called decanting or trust migration — from one situs to another when laws change or a better environment becomes available. A trust protector is often granted explicit power to authorize such a move.

Situs is sometimes confused with the physical location of the trustee or the beneficiaries, but those are separate questions. A family living in one state can establish a trust governed by another state's law, provided the trust has a qualifying connection to that jurisdiction — often through a resident trustee or trust company. The rules are technical, heavily jurisdiction-specific, and change over time, so families must work with qualified attorneys when selecting or changing a trust's situs.
