Trustee

A trustee is the individual or institution legally responsible for managing trust assets and administering the trust according to its governing document and applicable law.

The trustee occupies a fiduciary role — one of the highest standards of legal duty. This means the trustee must act solely in the interest of the beneficiaries, follow the terms of the trust agreement, keep careful records, and avoid conflicts of interest. Failing to meet these obligations can expose a trustee to personal legal liability. Families commonly appoint either a trusted individual (a family member, friend, or advisor) or a professional corporate trustee such as a bank or trust company.

Each choice carries trade-offs. An individual trustee may know the family's values and dynamics deeply but may lack investment expertise or the administrative infrastructure to manage complex assets. A corporate trustee brings institutional resources and continuity but may be less attuned to family nuance. Some families appoint a corporate trustee for administrative and investment functions while naming a family member as a "trust protector" — a separate role with limited powers, such as the ability to change trustees or modify certain provisions.

A trustee managing assets for a trust that holds private equity interests, real estate, and liquid securities faces genuine complexity. They must coordinate with the family's investment management function, track distributions, file required accountings, and communicate with beneficiaries — all while keeping the trust's specific objectives in view. This is one reason families building formal infrastructure through a single family office often integrate trust administration directly into the office's operations.
